The express terms of a contract of employment are those specifically agreed between the parties, whether verbally or in writing. In many cases these are few (the wage, the hours, the type of work that has to be done and where), but there are always other terms that are implied (that is, they exist without being stated or written down). An expressed contract requires that the elements are specifically stated, including offer, acceptance and consideration. There are other elements like mutual assent, capacity and legally accepted terms. Examples include the sale of real estate, employment contracts and even a contract to perform a service. However, if the term is implied by statute, the implied term will override the express term agreed by the parties.
